7.1 Mandatory Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in Prince George, British Columbia, Canada, before one arbitrator.
The arbitration shall be administered by the British Columbia International Commercial Arbitration Centre (BCICAC) pursuant to its Arbitration Rules. Judgment on the award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.
7.2 Class Action Waiver
YOU AND REMISSIONROUTE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and RemissionRoute agree, no arbitrator or judge may consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.
7.3 Exception for Small Claims
Either party may bring a claim in small claims court as an alternative to arbitration if the claim qualifies for small claims court in your jurisdiction.
7.4 Time Limitation on Claims
You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the website or these Terms must be filed within ONE (1) YEAR after such claim or cause of action arose or be forever barred.
